Here we go again…

I’ve got something to say about this, but it’s too late and I’m too fired up to write logically right now. I’ll post some articles that are hitting the wire right now.

Last Time I Checked, Rape Jokes Still Not Funny

Opie and Anthony - A Threat To Us All

Shock Jocks Opie and Anthony Discuss Sexual Assaults on Condi Rice and Laura Bush

If you want to hear the clip in question, listen at Orbitcast. If you are offended easily, or do not like dark humor, be warned. It talks about rape.

I’m going to sleep on it and write a my full thoughts tomorrow. For now though, just remember that the 1st amendment gives you, and Opie and Anthony, the right to offend and make you uncomfortable.

D T Nelson says:

It’s a shame you never learned about the Constitution. Here, let me explain it to you.

The First Amendment does not give anyone any rights. The only rights the Constitution gives are the rights the state governments ceded to the Federal government. “The Congress shall have the power … to regulate Commerce with foreign Nations … to establish Post Offices and post Roads … to provide and maintain a Navy,” e.g.. The Bill of Rights, Amendments One through Ten, was added because some states wouldn’t ratify the Constitution, thinking that the body of the document was not explicit enough in restricting the power of the Federal Government. At the time, some thought that it would confuse people, to go from positive statements of the rights the Federal government has, to negative statements of the rights the Federal government does NOT have; and we see that they were right, because you, and a lot of people, are confused.

The part of the First Amendment dealing with speech says that Congress shall make no law abridging the freedom of speech, and of the press. You were born with the right to free speech, and the body of the Constitution did not give the Federal government the right to regulate it; what this Amendment says is, just to make sure, Congress cannot regulate it. (Similar confusion exists over the Second Amendment — the people have the right to own guns, and the Federal goverment has no right to regulate them, whether there is a Second Amendment or not.)

That having been said, Opie and Anthony only have the right to offend as many people as can hear their voices. They have NO right to keep their jobs if they offend people. They can be fired for offending people, and the Constitution has NOTHING to say about that.

Lenna says:

I don’t think they should be fired for being offensive.

They should be fired for not being funny.
